Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), provoked conflict in the federal high court in Abuja on Monday after his bail request was denied.
Kanu, who has been detained for alleged treason charges, sought the court for bail or transfer from DSS custody to prison or be placed on house arrest instead.
The bail application was denied by the presiding judge, Binta Nyako. The judge concluded that only the appeal court could hear the case.
The judge ordered the DSS to always allow Kanu lawyers with no more than 5 persons each day to visit. She ordered that Kanu be provided “a clean place” to confer with his lawyers in the DSS detention facility and that he be allowed to choose a doctor.
However, Nyako warned that Kanu’s legal team filing such applications would be a blatant misuse of the judicial process.
Kanu, apparently furious, said the federal government violated the constitution and international conventions by forcibly bringing him to Nigeria.
“My Lord, you already ruled that you would not grant me bail until you determine the cause of my disappearance. Kanu waved a lot of law books in the dock to say you haven’t.
“I think you can’t try me without investigating that Killers arrived at my house!
“I don’t understand why my trial must violate the Nigerian Constitution. This is Nigeria’s current law.
“This court breaks Nigerian law. Section 2(3)(f) of the 2022 Terrorism (Prevention and Prohibition) Act is clear.”
Gboyega Awomolo, the prosecution attorney, advised Kanu’s lawyers to bring him to order.
Kanu stated of Awomolo: “This man is a terrorist for conducting a trial in violation of an international treaty Nigeria entered into. After signing, a treaty becomes law.
“They’re all terrorists! No Nigerian court can try me. Anything done in breach of any Nigerian treaty is terrorism”, Kanu raged.
“This man is a terrorist today. His dishonesty! You’re a terrorist! Who are you? Comply with the law.
“I have spent over three years in detention. As Chairman of the Body of Benchers, you are breaking national laws.”
Awomolo, a senior advocate of Nigeria (SAN), was astonished by Kanu’s outburst but not outraged.
“I am not a terrorist or provoked by the defendant. It makes sense. As a Senior lawyer I know He’s just emotional”.
Nyako postponed the case till June 19 and 20.
